Labor and Employment; Business Litigation; Securities Litigation and Arbitration
Mr. Eisenstat defends and tries cases in federal and state courts and represents clients in arbitration proceedings throughout Texas and the Southwest. His practice also includes appearances before governmental administrative agencies and tribunals. He has extensive experience representing management in all aspects of traditional employment law (including discrimination claims, wrongful termination, sexual harassment, and retaliation), as well as covenants not to compete, theft or misappropriation of trade secrets, unfair competition claims, and agency disputes. Mr. Eisenstat also represents executives in employment matters, such as negotiating employment agreements and severance packages, and counseling employers in pre-litigation employment matters, including class action avoidance.
In addition to meeting the employment-related needs of his clients, Mr. Eisenstat also represents clients in business litigation matters, such as securities disputes, real estate and contractual disputes, e-commerce issues, and business tort cases. Mr. Eisenstat has won many difficult cases through carefully crafted summary judgment motions and at trial. He has earned a reputation for negotiating very favorable results in hotly contested, difficult disputes. At the core of Mr. Eisenstat’s service philosophy is an emphasis on understanding and appreciating client goals. This is a primary reason that he enjoys numerous, longstanding relationships with his employment and business clients. His clients include major corporations in the aerospace and defense industry, the securities industry, the real estate industry and the e-commerce sector.
Mr. Eisenstat also serves as a member of the firm’s executive committee. In addition, he has served for over 7 years as a certified mediator in disputes involving complex business issues, partnership disagreements, employment law, civil rights, personal injury claims, and class actions. This training and experience further enhance the problem-solving skills and capabilities that he brings to all his representations.

Mr. Eisenstat is also actively involved in many civic, leadership and philanthropic organizations and serves on the board of directors for different non-profit corporations.
